Lakhimpur Kheri Case: Bail for Union Minister’s Son Challenged in SC by victim’s families

Lakhimpur Kheri: The victim’s families challenged the bail for Union Minister’s son Ashish Mishra. Mishra is accused of running over farmers in UP, during the farmers’ protest.

The families of the victims killed in Uttar Pradesh’s Lakhimpur Kheri approached the Supreme Court. They challenged the bail granted by the Allahabad High Court. However, the plea was filed by advocate Prashant Bhushan.

Prashant Bhushan said the Allahabad High court granted bail despite “overwhelming evidence” against the minister’s son.

The plea said,“High court granted bail without considering the heinous nature of the crime. The character of the overwhelming evidence against the accused in the chargesheet. Moreover, the position and status of the accused with reference to the victim and witnesses, the likelihood of the accused fleeing from justice and repeating the offence and the possibility of his tampering with the witnesses and obstructing the course of justice.”

In addition to this, the plea also stated that victims were stopped from presenting the relevant material to the High Court’s notice.

According to the plea, “The counsel could barely make any submissions and repeated calls to the court staff to get reconnected went futile. Hence, an application filed by the victims before High Court for an effective rehearing was rejected.”

The petitioners were shocked to see that the minister’s son was granted bail., despite overwhelming evidence. Apparently, the state government failed to file an appeal against the Allahabad High Court order granting bail.

However, this is the second plea against the Union Minister’s son.The first plea was filed two days after Ashish Mishra was released from the prison.

The families of the victims are worried that the evidences may be tampered. Furthermore, the life of the witnesses can be under threat.
