Ashish Mishra’s Bail cancelled by SC in farmer’s killing case in Lekhimpur

The supreme court ruled out the Allahabad court order and said that it is based on “irrelevant observations”.

Ashish Mishra is accused of murdering farmers in Uttar Pradesh last year, was granted bail on February 10. However, the Supreme Court cancelled it today. Ashish Mishra, is the son of Union Minister Ajay Mishra Teni.

Ashish Mishra was granted bail by the Allahabad High Court on February 10. He was granted bail during the campaign for the Uttar Pradesh election. Subsequently, the families of the farmers challenged this bail. The farmers were killed on October 3 at Lakimpur Kheri in UP.

The Supreme Court ruled that the High court order is based on “irrelevant observations” and “overlooked relevant considerations”.

The victim has unbridled participatory right in such a criminal trial process,” Justice Surya Kant said in sharp words while announcing the decision.

“We hold that the victims have been denied the chance of effective hearing”, he said.

In the recent hearing, the UP government said Ashish Mishra is “not a flight risk”. The government said that the offence is ‘grave’. The UP government is accused of having a soft corner to the son of the influential Union Minister.

It claimed that it had argued before the High Court that it was a grave offence and ‘no words were enough to condemn the offence’.
