Three years jail for Spreading Fake News, under Bharatiya Nyaya Sanhita Bill

The Bharatiya Nyaya Sanhita Bill, 2023, introduced in the Lok Sabha has proposed that spreading of “fake news or misleading information” would be punished with up to three years in jail.

On Friday, Union Home Minster in Lok Sabha introduced three new bills to replace the existing IPC, CRPC, and Evidence Act bills. The Bharatiya Nyaya Sanhita Bill, 2023, Bharatiya Nagarik Suraksha Sanhita Bill, 2023, and Bharatiya Sakhshya Bill, 2023 are the three new bills introduced in Lok Sabha.

According to news reports, the Bharatiya Nyaya Sanhita Bill, 2023, proposed by Home Minister Amit Shah, has been forwarded to the Standing Committee for review.

A provision under Section 195 states that people who spread ‘fake news or misleading information’ jeopardizing India’s sovereignty and security shall face up to three years in jail.

Section 195 (1) d states “makes or publishes false or misleading information jeopardizing India’s sovereignty, unity, integrity, or security shall be punished with imprisonment which may extend upto three years, or with a fine, or with both.”
