A wife applied for husband’s Income details using Right To Information (RTI). Subsequently, the Central Information Commission (CIC) directed the I-T department to provide the woman with the generic income of her husband. within 15 days.
Married couples are expected to share everything with each other, especially about how much they earn. They are supposed to disclose everything to their spouses. However, this doesn’t happen in case of a marital dispute, things are quite different.
When a couple files for a divorce, their finances, their emotional challenges, assets etc are impacted. Furthermore, if the divorce is not mutual, the wife may seek income details from her husband and demand maintenance.
According to “The Financial Express” the Central information Commission(CIC) recently, directed the Income Tax department to provide a woman with the generic details of her husband net taxable income/gross income within 15 days.
The woman, Sanju Gupta, filed an RTI seeking the income details of her spouse. Earlier, the Department office of the Income Tax Officer refused to provide the details under RTI as the husband did not give his consent to it.
After that, the woman appealed to the First Appellate Authority (FAA). However, the report added that the FAA upheld the CPIO’s order, prompting Gupta to file a second appeal with the CIC.
The Central Information Commission went through some of its past orders and judgments of the Supreme Court and High Courts and gave its order on September 19, 2022.
