District Consumer Disputes Redressal Commission fined D-Mart for taking fees for a carry bag that has its own brand logo. D-Mart is fined Rs 1,500 in compensation which includes Rs 500 towards compensation to the complainant for the hardship caused and Rs 1,000 towards the costs of litigation.

Pakolu Naresh resident of Sanath Nagar, filed a complaint against D-Mart for charging him for a carry bag with the company’s mark printed on it. Naresh argued that the bag has a brand name that is used as a promotional message and why he should pay for promoting the brand which is an unfair practice.

After a thorough checking of the carry bag, the court agreed to the arguments and concluded that the bag was charged an MRP of Rs 5 inclusive of all taxes and purposefully sold to its customers to carry the goods that they had purchased in their stores, as well as using it unauthorized as a medium of advertisement.
